1. Who operates Formless

Formless is a software product developed and operated by SquadVertex ("Formless", "we", "us", or "our"). References to third-party products, payment providers, or trademarks are for identification or compatibility and remain the property of their respective owners.

2. The service and availability

Depending on the features enabled for your account, Formless may let you create and publish forms, collect responses and files, manage restaurant menus, receive order or service requests, coordinate restaurant staff workflows, and view related workspace information. Features, plan limits, and availability may change as the product develops.

We work to keep Formless available and secure, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, outages, third-party failures, or events outside our reasonable control may affect the service. We may update, suspend, or discontinue a feature where reasonably necessary, subject to applicable law and any commitments specifically made to you.

3. Accounts and workspace security

You must provide accurate account information, keep your sign-in credentials and authentication methods secure, and promptly notify us of suspected unauthorised access. You are responsible for activity carried out through your account, except where applicable law provides otherwise or the activity resulted from our own failure to meet a legal obligation.

Workspace owners are responsible for granting appropriate access to managers, staff, collaborators, and other users, and for removing access when it is no longer needed.

4. Your content and submitted information

You retain the rights you already hold in the forms, menu details, images, text, settings, and other material you submit to Formless ("Your Content"). You give us a limited, non-exclusive permission to host, store, process, display, and transmit Your Content only as reasonably necessary to operate, secure, support, and improve the service, or as otherwise permitted by law.

You are responsible for ensuring that you have the rights, permissions, notices, and consents required to upload Your Content and collect or use information through your forms or restaurant workspace. Do not use Formless to collect passwords, payment-card security codes, government identity numbers, or other highly sensitive information unless the collection is lawful and you have implemented all required safeguards.

You must not upload content that is unlawful, infringes another person's rights, or contains malware. You should keep your own backups of important information. Data availability and retention may be affected by account status, product limits, legal requirements, and our published privacy practices.

5. Your responsibilities when using forms or restaurant tools

You agree not to use Formless to:

• carry out fraud, phishing, spam, harassment, unlawful discrimination, or other illegal activity;
• collect personal information without an appropriate lawful basis, notice, or permission;
• interfere with platform security, bypass access controls, probe systems without authorisation, or disrupt other users;
• misrepresent your identity, business, products, prices, availability, or authority to collect information; or
• use the service in a way that violates applicable law or another person's rights.

If you use Formless for restaurant operations, you remain responsible for the accuracy of menu items, prices, ingredients and allergen information, applicable licences and food-safety obligations, and the preparation, fulfilment, cancellation, and refund of orders. Formless provides software tools; unless expressly agreed otherwise, we do not prepare or deliver food, act as the restaurant, or guarantee that a restaurant will accept or fulfil a request or order.

6. Respondent and customer data

If you create forms or use restaurant features to collect information from customers, respondents, or staff, you are responsible for determining what information to collect, providing any required privacy notice, obtaining any required consent, responding to requests from those individuals, and complying with applicable data-protection law. Our respective responsibilities depend on the feature and how the information is processed; this section does not override applicable law.

Our handling of account and service data is described in the Privacy Policy. Please review it before using the service to collect personal information.

7. Subscriptions, payments, and taxes

Some features may require a paid subscription. Before you pay, review the plan, displayed price, billing frequency, applicable taxes, and any plan limits shown at checkout. By starting a recurring subscription, you authorise the payment provider to process the charges disclosed during checkout for the selected billing cycle until the subscription is cancelled under the available cancellation process.

Payments may be processed by Razorpay or another third-party payment provider and are also subject to that provider's applicable terms. Subscription activation or continued access may depend on payment confirmation and verification. If a payment fails, a subscription expires, or access is suspended, paid features may become unavailable.

To ask about cancellation, billing errors, or a refund, use our contact page. Any refund or cancellation will be handled according to the terms shown when you subscribed, the payment provider's process, and applicable law. Nothing in these Terms removes any non-waivable rights you may have.

8. Intellectual property

Except for Your Content and third-party material, Formless and its software, interface, branding, visual assets, and documentation are owned by or licensed to SquadVertex and are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the service for its intended purpose; they do not transfer ownership of the service to you.

9. Third-party services and links

Formless may depend on or link to third-party services, including authentication, hosting, storage, analytics, and payment providers. Those services may be subject to separate terms and privacy policies. We are not responsible for services that we do not control, although this does not limit responsibilities imposed on us by law.

10. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect users or the service, respond to a security incident, comply with law, address non-payment, or investigate a material breach of these Terms. Where reasonable and appropriate, we will provide notice and an opportunity to resolve the issue. We may terminate access for serious, repeated, or unlawful misuse.

You may stop using Formless at any time. Stopping use of the service does not by itself cancel a recurring payment mandate; please follow the applicable subscription cancellation process and check for confirmation. Following termination, access to workspace content may be restricted or deleted in accordance with our Privacy Policy, applicable law, and any retention obligations.

11. Disclaimers and limitation of liability

To the extent permitted by applicable law, Formless is provided on an "as available" basis, and we do not promise that it will meet every business requirement or be free of every interruption, error, or data loss. You should use appropriate operational safeguards and maintain independent copies of information that is important to you.

To the extent permitted by law, SquadVertex will not be liable for indirect or consequential loss arising from use of the service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or any statutory rights or remedies that apply to you.

12. Changes to these Terms

We may update these Terms as the service, our practices, or applicable law changes. We will update the date at the top when a revised version is published. Where required by law, we will give notice of material changes. Continued use after the effective date of an update means the revised Terms apply to your future use, to the extent permitted by law.

13. Governing law and contact

These Terms are governed by the laws of India, subject to any mandatory laws and consumer protections that apply to you. Disputes will be handled by the courts or other authorities with jurisdiction under applicable law.
